Diversified Business Services  aka DBS Marketing Services, (“DBS”) a division of ICDA, Inc., is a fully integrated provider of marketing, customer list management, and data services. We insist on providing our clients the highest level of privacy and security with regard to both your personal information and the list data you submit to us for processing, third party pustomer Information and your private library data

 

As part of any number of our services, you will be sending via hard data file, email, or FTP, customer and sales prospect lists, as well as, marketing communications creative materials and documents to us for processing. Diversified Business Services understands that full ownership of the data files and creative materials provided by our clients will remain the exclusive property, including all rights thereof, of the rightful owners of such data and materials. We agree to process the data provided by our clients, for the sole purpose of providing them with market campaign, data processing and list management services. Diversified Business Services agrees not to use said data for any additional purpose, unless authorized in writing by the company submitting the data, and also agrees not to disclose your customer’s data to any other organization or individual in any manner that would be outside of the scope of the requested services. Diversified Business Services may use the services of independent contractors or temporary employees in order to complete any job. Diversified Business Services agrees to have employees, outside vendors, independent contractors, or temporary employees sign a confidentiality agreement upon request.

Unless directed otherwise, Diversified Business Services may purge the data from its systems after completion of the job

 

Diversified Business Services offers, as a convenience to our clients, the opportunity to store its customer lists and creative libraries in private, files on Diversified Business Services servers to be used by the client for future marketing campaigns. These lists and libraries are fully accessible to the client at any time for addition or deletion, as the client requires.

 

Privacy regarding 3rd party data: DBS provides 3rd party data from various vendors for use in client’s marketing  efforts. Data is acquired by information that is from public sources, proprietary data, survey results, membership records, and other sources. DBS can not be held responsible for the validity of the data, but is in the position of only being a pass-through from the owners of the data to the client. It is the client’s responsibility to comply with all laws in the use of such data. Clients agree to only use data acquired through DBS in a lawful manner and takes responsibility for adherence to local and federal laws regarding privacy and furthermore, to indemnify DBS in the event of legal action regarding the data used and privacy laws.

 

Notice to Marketers:  California has a new privacy law that took effect January 1, 2020
This law grants consumers a right to request companies that are in the business of selling data to disclose the categories and specific pieces of personal information that is collected about the consumer. It grants the consumer the right to request deletion of personal information and requires the business to delete their information upon request. Failure to respond could result in penalties.

"Personal information" means information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information includes, but not limited to using a real name, alias, online identifier,  postal address, email address, etc.

The bill, however, specifically allows use of personal information that is gathered from "publicly available information". 

To comply with this, a suppression file would need to be created of people who make this request. DBS will require our clients to take full responsibility for compliance with the requirements of California law on maintaining suppression files and remove said people from the database prior to using. Clients agree to indemnify DBS in the event of consumer complaints or legal action in the use of 3rd party data acquired for marketing purposes.

Your Consent

DIVERSIFIED BUSINESS SERVICES may, in certain circumstances disclose or release information when we, in good faith, believe that it is necessary to (i) comply with the law, (ii) enforce or apply the terms of any of our user agreements, or (iii) protect the rights, property or safety of DIVERSIFIED BUSINESS SERVICES, our users, or others (iv) use outside vendors for services needed by DIVERSIFIED BUSINESS SERVICES in order to complete the job. By using our products and services, you consent to the collection and use of information by us as described in this Privacy Policy. Changes to our policy will be posted here so you will always know what information we gather, how we use it and under what circumstances we disclose it.
